Terms of Sale

1. Purpose

These Terms of Sale (ToS) govern the booking and payment of services ordered via Ti-Services.

2. Prices

Prices are fixed and displayed before the order is confirmed. An optional “boost” surcharge may be added by the Client; it goes to the Provider and, being added to the price of the service, forms part of the commission base. VAT not applicable — Saint-Barthélemy (a collectivity outside the scope of French VAT).

Tip. After the service, the Client may, if they wish, leave a tip. It is a gratuity: entirely optional, never pre-filled or suggested by default, it is not part of the price of the service and declining it has no consequence. It is paid over to the Provider less Ti-Services' commission, calculated at the same rate as the one applied to the service. It appears on the invoice as a separate line. Any travel fee likewise goes entirely to the Provider, outside the commission.

3. Order

The request is confirmed when a Provider accepts it. The Client receives progress tracking.

4. Payment

Payment is secure and charged after the service is approved by the Client, within the limit of the agreed amount. No commission is re-billed to the Client.

Tacit approval after 48 hours. Once the Provider has declared the service complete, the Client has forty-eight (48) hours to approve it or report a problem. A reminder is sent before the deadline, stating the exact date and time. Failing a response within that period, the service is deemed accepted and the agreed amount is charged, so that the Provider is paid for their work. This tacit approval never applies: (i) where the Client has reported a problem or disputed the service, for as long as the matter is unresolved; (ii) where the amount due exceeds the amount accepted at ordering (in particular an upward revision of the duration), which requires the Client's express agreement. It is without effect on the Client's rights: complaints, legal warranties and the right of withdrawal remain exercisable within their own time limits.

5. Invoicing

The invoice is issued by Ti-Services in the name and on behalf of the Provider, under a billing and collection mandate accepted by the Provider on registration (art. 289 of the CGI for billing). Ti-Services collects on their behalf the sums owed to them — price of the service, boost, travel fee and tip — and pays them over, less its commission alone, which does not apply to the travel fee.

Floor on small orders. Where the commission base of a service is below €21, the rate applied is raised to a minimum of 10%, whatever rate the Provider otherwise benefits from (loyalty tier, Ambassador status, etc.). This floor covers the fixed bank collection costs, which do not depend on the amount collected.

6. Right of withdrawal

In accordance with articles L221-18 et seq. of the French Consumer Code, the consumer Client has a period of fourteen (14) days to withdraw from a service contract concluded at a distance, without having to give reasons or bear any costs. The period runs from the conclusion of the contract.

Where the Client expressly requests that the service begin before the end of this period (in particular for a job on a near date), they are informed and acknowledge that: (i) they waive their right of withdrawal once the service is fully performed; (ii) in the event of withdrawal during performance, they remain liable for the amount corresponding to the portion of the service already performed.

To exercise this right, the Client notifies their decision by an unambiguous statement (by email to contact@ti-services.fr). A model withdrawal form is available on simple request at this address.

7. Cancellation

Before acceptance. As long as no Provider has accepted the request, the Client may cancel it at any time and at no charge.

After confirmation. Once a Provider has accepted the request, cancellation remains free until eight (8) hours before the agreed appointment time. Any cancellation less than 8 hours before the scheduled start entitles the Provider to a cancellation fee equal to 50% of the total order amount (service price, boost and travel fee included), in compensation for the slot they had reserved. That entitlement is theirs: it is for them to apply it or waive it, and they are informed of this in the app. No fee is due unless they have claimed it. Ti-Services collects its usual intermediation commission on the fee actually applied, under the same conditions as for a completed service.

No fee is due when the cancellation results from a Provider's failure (absence, significant delay, non-compliant service): in that case, the Client is charged nothing.

8. Ti-Services guarantee & claims

If a provider is absent or a service is non-compliant, the Client is not charged for a service that was not performed (payment guarantee). Ti-Services makes its best efforts to offer a solution — finding a new provider, mediation — without however guaranteeing the availability of a replacement, the Platform not being the Providers' employer and unable to compel their presence. 9. Liability

The service is performed under the sole responsibility of the Provider (see the Provider Responsibility Charter). Ti-Services' liability in its role as intermediary is limited under the conditions set out in the ToU, without prejudice to the consumer's mandatory rights.

10. Platform transparency

Requests are offered to verified Providers on a chronological “first come, first served” basis: the first available Provider who accepts wins the job. This ranking is not influenced by any payment made by the Providers. Ti-Services collects an intermediation commission on completed services, with no effect on the price paid by the Client (no commission is re-billed to the Client).

11. Consumer mediation

In accordance with articles L611-1 et seq. of the French Consumer Code, the consumer Client has the right to use a consumer mediator free of charge for the amicable resolution of a dispute, after having sent a written claim to Ti-Services (contact@ti-services.fr) that has gone unanswered satisfactorily within two months. The details of the competent consumer mediator: as of today, Ti-Services has not appointed a consumer mediator. The Client remains free to bring the matter before the competent court, and Ti-Services undertakes to provide the mediator's contact details as soon as a body has been appointed.

12. Governing law

These terms are governed by French law.
